MiFaZ Terms of Use
This English translation is provided for information only. Only the German version is legally binding.
§ 1 Subject matter of MiFaZ
-
MiFaZ is operated by JaSt-IT. The full provider and contact details can be found in the imprint.
-
These Terms of Use govern the registration and use of MiFaZ by its users.
-
MiFaZ provides a digital platform through which users can offer, search for and organise rides.
-
MiFaZ merely provides the technical means for making contact and organising a carpool. It does not become a party to any ride agreed between users and owes neither the formation nor the performance of a carpool.
-
Agreements on travel times, meeting points, destinations, cost contributions and other details are made exclusively between the users involved.
-
As a rule, MiFaZ does not verify the identity, driving licence, fitness to drive, reliability, insurance arrangements or other details of users.
§ 2 Registration and user account
-
As a rule, registration with MiFaZ is permitted only from the age of 18. By registering, users confirm that they have reached the required minimum age.
-
On completion of registration, a free-of-charge contract of use is concluded between the user and JaSt-IT on the basis of these Terms of Use.
-
Complete and truthful information must be provided when registering and using MiFaZ. The stored data must be kept up to date.
-
As a rule, only one user account may be created per person. The user account may not be transferred to other persons or made available to other persons for their use.
-
Login credentials must be protected against access by third parties. If there is reason to suspect that third parties have gained access to a user account, MiFaZ must be informed without undue delay.
-
Contact details may only be entered in the fields provided for this purpose. In particular, phone numbers, email addresses, postal addresses or other personal contact details may not be published in publicly visible free-text fields, ride offers or profile descriptions.
-
There is no entitlement to registration or to the permanent provision of a user account.
§ 3 Costs and commercial use
-
The use of MiFaZ is free of charge for drivers and passengers.
-
Any cost contribution is agreed and settled exclusively between the driver and the passenger. MiFaZ is not involved in this agreement and does not handle the billing, collection or forwarding of payments.
-
A cost contribution may not be aimed at making a profit and may not exceed the passenger's reasonable share of the travel costs actually incurred. The calculation and agreement of the cost contribution is the responsibility of the users involved.
-
Commercial listings, profit-oriented passenger transport and other commercial uses of MiFaZ are permitted only with the prior written approval of JaSt-IT and, where required, of the operator of the respective regional portal.
§ 4 Obligations of users
-
Drivers and passengers are obliged to comply with the agreements made between them wherever possible.
-
Changes, delays, cancellations or a necessary termination of a ride must be communicated to the other parties involved without undue delay, insofar as this is possible and reasonable.
-
Users must treat other users with respect and respect their rights, safety and personal boundaries.
-
Users may not use MiFaZ for unlawful purposes.
-
Users may contact other users exclusively to search for, agree on and carry out a carpool. Using the contact options for advertising, canvassing, private attempts at contact unrelated to a carpool or other messages unrelated to this purpose is not permitted.
-
Without the consent of the persons concerned, the data accessible via MiFaZ may not be:
- used for advertising or marketing purposes,
- passed on to unauthorised third parties,
- read out or collected by automated means, or
- used outside the organisation of specific carpools.
§ 5 User content and content moderation
Users can post their own texts and images on MiFaZ. Users are responsible for the content they post.
By posting content, users confirm that they are entitled to do so and that the content does not infringe any rights of third parties or statutory provisions.
By posting content, users grant JaSt-IT, for the duration of its publication, the non-exclusive right, limited to the operation of MiFaZ, to store the content, reproduce it technically, format it and make it accessible within MiFaZ to the intended group of users. In particular, images may be technically adjusted in size or file format. As a rule, the right of use ends when the content is deleted.
5.1 Prohibited content
In particular, no content may be posted or transmitted via MiFaZ that:
- is insulting, threatening, harassing or defamatory;
- degrades people on the basis of their origin, skin colour, religion, gender, sexual identity, disability or other personal characteristics;
- calls for violence or criminal offences or glorifies violence;
- incites hatred against groups of people, is directed against the constitutional order or is otherwise unlawful;
- is pornographic or harmful to minors;
- infringes personality rights, copyrights, trademark rights, data protection rights or other rights of third parties;
- spreads false statements of fact about other persons;
- contains malware, malicious code or links to harmful content;
- contains unauthorised advertising, spam, chain messages or fraudulent offers;
- does not serve the organisation of carpools and misuses MiFaZ for other purposes, or
- violates supplementary MiFaZ rules of conduct that are accessible to users.
5.2 Review of content and photos
-
As a rule, MiFaZ does not carry out a general proactive review of all content posted or transmitted by users.
-
Before they are published, photos uploaded by users are checked by an external automated review service for potentially inadmissible image content.
-
If a photo is flagged by the automated review service, it is automatically rejected and not published.
-
If users believe that the automatic rejection of their photo was wrong, they can request a new review via the contact form provided for this purpose. The photo can then be reviewed manually and approved if appropriate.
-
Other content may be reviewed in particular if:
- it is detected in the course of operating MiFaZ;
- a report is received from a user or a third party;
- a notification from an authority or a court is received, or
- there are other specific indications of a violation of the law or of these Terms of Use.
5.3 Measures in the event of violations
-
If content violates statutory provisions or these Terms of Use, it may be deleted.
-
As a rule, the user concerned is informed of the deletion and its main reasons. This does not apply insofar as statutory provisions, official orders, security interests or the protection of affected persons prevent such information.
-
In the case of a first or less serious violation, the user may initially be warned and asked to comply with the Terms of Use in future.
-
In the case of serious or repeated violations, the user account may be deleted after a prior warning.
-
A prior warning is not required if:
- there is a serious or obviously unlawful violation;
- other users are endangered, threatened or seriously harassed;
- MiFaZ is used for fraudulent or criminal acts;
- technical protective measures are circumvented or the security of MiFaZ is impaired, or
- a prior warning is unreasonable for other reasons.
-
The decision takes into account in particular the nature and severity of the violation, possible consequences for other persons, previous violations and the proportionality of the measure.
-
The competent authorities may be informed insofar as this is required by law or legally permissible.
5.4 Reporting illegal content
-
Users and third parties can report listings, profiles or other content that they consider to be illegal.
-
The electronic DSA report form linked on MiFaZ is available for this purpose. The form can also be reached via the “Report content” link on the respective content.
-
The report must contain in particular:
- a sufficiently substantiated explanation of why the content is considered illegal;
- the exact electronic location of the content or other information with which the content can be clearly identified;
- the name and email address of the person submitting the report, unless a statutory exception applies;
- a statement that the report is complete and accurate to the best of their knowledge.
-
MiFaZ confirms receipt of the report electronically and reviews it in a timely, diligent, objective and non-arbitrary manner.
-
The person submitting the report is informed of the decision taken and of possible means of redress, insofar as contact details are available and there are no statutory reasons to the contrary.
-
As a rule, the identity of the person submitting the report is not disclosed to the user concerned. It may be disclosed if this is required by law, ordered by an authority or a court, or necessary for the pursuit of legal claims.
§ 6 Making contact and communication
-
Users can contact each other via the internal MiFaZ chat system.
-
If a user has released a phone number for contact purposes, another user can explicitly have it displayed using the button provided for this purpose and then contact them by phone.
-
Phone numbers are not displayed without such an explicit action. The email address stored in the user account is not displayed to other users.
-
Contact details obtained via MiFaZ may only be used to agree on and carry out a carpool.
-
After a contact function has been used – in particular after a chat message has been sent or a phone number has been displayed – MiFaZ may send the users involved an automated email asking whether a carpool has been formed.
-
The success follow-up serves to determine whether a match was successful as well as for statistical evaluation and improvement of the service. Further details on the associated data processing can be found in the privacy policy.
-
As a rule, chat messages are automatically deleted three years after they were created. If a conversation then no longer contains any messages, the conversation is deleted as well.
-
When a user account is deleted, the content of the chat messages sent from this account is removed. Instead of the original content, a neutral notice that the message has been deleted may remain visible to other participants.
-
Statutory retention obligations and permissible storage for the establishment, exercise or defence of legal claims remain unaffected.
-
To keep ride offers, ride requests and other entries up to date, MiFaZ may send an automated request at regular intervals, in particular every six months, asking whether they are still valid.
-
MiFaZ may send necessary service messages, in particular:
- on the registration and management of the user account;
- on the security of the user account;
- on the confirmation or updating of entries;
- on chat messages and contact requests;
- on success follow-ups;
- to resolve technical or organisational problems;
- to process reports and support requests.
- Advertising and other messages that are not required for the performance of the user relationship are only sent in accordance with the statutory provisions.
§ 7 Availability
-
JaSt-IT endeavours to ensure that MiFaZ is available with as few interruptions as possible. However, availability at all times and completely free of faults cannot be guaranteed.
-
Use may be temporarily restricted in particular due to maintenance work, security measures, technical faults or events beyond the control of JaSt-IT.
-
No particular success in matching, making contact or transport is owed.
§ 8 Account deletion
-
Users can delete their user account at any time without giving reasons and thereby terminate the user relationship.
-
JaSt-IT may delete a user account in the event of serious or repeated violations of these Terms of Use.
-
Deletion may be considered in particular if a user:
- uses false identity information;
- endangers, threatens or seriously harasses other users;
- uses the platform for unlawful or fraudulent acts;
- uses contact options for purposes other than those intended;
- circumvents technical protective measures or impairs the security of MiFaZ;
- continues a violation despite a prior warning.
-
Insofar as possible and reasonable, users are warned before their account is deleted and given the opportunity to respond. In the case of serious violations, the user account may be deleted without prior warning.
-
User accounts may also be deleted if MiFaZ or the regional portal concerned is permanently discontinued.
§ 9 Liability
-
JaSt-IT is not a party to the carpools agreed between users.
-
In particular, JaSt-IT is not liable for:
- a carpool being formed or not being formed;
- the performance, change, delay or cancellation of a ride;
- road accidents or other events during a ride;
- the conduct, fitness to drive or reliability of a user;
- incorrect, incomplete or outdated information provided by a user;
- agreements or disputes between drivers and passengers;
- damage caused by one user to another user or to a third party.
-
Liability for breaches of duty by JaSt-IT itself remains unaffected.
-
For its own breaches of duty, JaSt-IT is liable without limitation in cases of intent and gross negligence and in the event of culpable injury to life, body or health.
-
In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for the contract. Material contractual obligations are obligations whose fulfilment is essential for the proper provision of MiFaZ in the first place and on whose compliance the user may regularly rely.
-
Otherwise, the liability of JaSt-IT for damage caused by slight negligence is excluded.
-
Mandatory statutory liability remains unaffected.
§ 10 Data protection
-
Personal data is processed in accordance with the applicable data protection regulations.
-
Further information, in particular on the display of phone numbers, success follow-ups, the retention period of chat messages, the automated review of photos by Google and on recipients and data subject rights, can be found in the MiFaZ privacy policy.
